a.      Section 551.071.  Meeting with City Attorney regarding a matter(s) in which the duty of the City Attorney under the Texas Disciplinary rules of Professional Conduct of the State Bar of Texas conflicts with the Open Meetings Act regarding:

                                i.            Update on Cause 2006-50103-367; City of Frisco, Texas vs. Shoemaker;

                              ii.            Legal issues regarding Batch/Cement Plants on SH 121;

                            iii.            Update and legal issues regarding the Tolling of State Highway 121.

b.      Section 551.072.   To deliberate the purchase, exchange, lease or value of real property located:

                          i.      South of US 380, North of Lebanon Road, East of FM 423, and West of Preston Road.

c.      Section 551.087. Deliberation regarding commercial or financial information that the City has received from a business prospect and to deliberate the offer or other incentives to a business prospect.

A.)  Consider and act upon approval of the Minutes from the March 6, 2007  Regular City Council Meeting.  (City Secretary)

 

B.)  Consider and act upon adoption of a Resolution approving the request of the Arts of Collin County Commission, Inc. (ACC) to retain unused operating funds in accordance with the Interlocal Agreement between the ACC and the three owner cities. (City Manager’s Office/HJH)

 

C.)  Artwork for the Senior Center at Frisco Square:

i.)      Consider and act upon the approval of an Agreement by and between Justine Wollaston and the City of Frisco for the fabrication and delivery of the proposed Frisco Watercolor Map for the Senior Center at Frisco Square, and adoption of a Resolution authorizing the City Manager to execute the Agreement. (City Manager’s Office/AG)

ii.)    Consider and act upon the approval of an Agreement by and between David Iles (d/b/a Bolivar Bronze) and the City of Frisco for the purchase and installation of his artwork titled “Wildlife at the Frisco Senior Center” for the Senior Center at Frisco Square, and the adoption of a Resolution authorizing the City Manager to execute the Agreement. (City Manager’s Office/AG)

 

D.)  Artwork for the Heritage Park:

i.)      Consider and act upon the approval of an Agreement by and between Enigma Lake Art Co. and the City of Frisco for the fabrication and installation of the proposed Entryway Project for Frisco Heritage Park, and adoption of a Resolution authorizing the City Manager to execute the Agreement. (City Manager’s Office/AG)

ii.)    Consider and act upon the approval of an Agreement by and between Janice Hart Melito (d/b/a Montage Imagers, Inc.) and the City of Frisco for the fabrication and installation of the proposed “Human Threads” mural for the Frisco Heritage Museum, and adoption of a Resolution authorizing the City Manager to execute the Agreement. E.)  Consider and act upon a Resolution authorizing the City Manager to enter into a Detention Facilities Agreement with Weston Grain Co., Inc., James Wade, C. J. Wade and the Pansy Family Limited Trust for the Proposed Wade Plaza Detention Pond. (Engineering/EM)

 

F.)   Consider and act upon a Resolution authorizing the City Manager to execute an Amendment Number Two to the Professional Services Agreement by and between the City of Frisco and Halff Associates, Inc. for the design of the Panther Creek Sewer Interceptor, Phase 1 and Phase 2. (Engineering/EM)

 

G.)  Consider and act upon a Resolution authorizing the City Manager to execute Amendment Number Four to AIA Document (A121/CMC) Standard Form Agreement (dated May 11, 2005) by and between the City of Frisco and Lee Lewis Construction, Inc to perform additional Construction Manager At-Risk Services for the Construction of the Frisco Police/Holding Facility, including Crime Lab and Crime Lab Offices, Firing Range and Additional Paving. (Engineering/CS)

 

H.)  Consider and act upon approval of a purchase order for annual maintenance fees to ESRI, Inc. for Arcview GIS software and support. (Information Technology/SO)

 

I.)      Consider and act upon approval of a Resolution authorizing the City Manager to execute an Amendment to the Agreement by and between the City of Frisco and JDC Construction for the Construction of Hillcrest Trails. (Parks and Recreation/DR)

 

J.)    Consider and act upon approval of a purchase order to Motorola for the purchase and installation of a Motorola traffic signal wireless communications system, through HGAC. (Engineering)

 

K.)  Consider and act upon award of bid #0701-016, annual contract for Bermuda and St. Augustine sod. (Parks & Recreation)

 

L.)   Consider and act upon award of bid #0701-019, annual contract of landscape and irrigation maintenance. (Building Services/GB)

 

M.) Consider and act upon award of bid #0702-032 for a Senior Center transport bus. (Parks & Recreation)

 

N.)  Consider and act upon the approval of an Amendment #2 to an Agreement by and between Howard Meehan and the City of Frisco for a materials change for the proposed B. F. Phillips Community Park artwork, and adoption of a Resolution authorizing the City Manager to execute the Amendment. (City Manager’s Office/AG)

 

O.)  Consider and act upon award of bid #0702-031 for a forensic light source system. (Police)

 

P.)  Consider and act upon approval of a purchase order for water testing services to the Lower Colorado River Authority. (Public Works)

 

Q.)  Consider and act upon award of a contract with The Trails of Frisco Golf Course for hosting the FUTURES Golf Tour, Inc. and adoption of a Resolution authorizing the City Manager to execute the contract. (CVB)

 

9. Legislative Agenda:

(These items may legally require Council Action, but by Council Policy should be the City Manager’s responsibility.  The Legislative Agenda can be acted upon in one motion.  The concurrence of two council members is required to remove any item for separate discussion and action.  Council members may vote nay on any single item without comment and may submit written comments as part of the official record.) 

A.)  Consider and act upon adoption of an Ordinance granting a Specific Use Permit for an expansion of a Child Day Care Center on 2.5± acres on the south side of Stonebrook Parkway, 100+ feet east of Oakbrook Drive.  Specific Use Permit SUP06-0018.  Neighborhood #23.  (Planning & Development Services)

 

B.)  Consider and act upon adoption of an Ordinance changing the name of Newman Road to Ivy Lane.  (Planning & Development Services)

 

Regular Agenda:

10. Consider and act to give staff direction on the request of Stonelake Estates’ residents to close Ryan Street.  Neighborhood #15.  (Planning & Development Services)

 

11. Public Hearing:  Zoning Case Z07-0005, A request to rezone 8.2+ acres on the west side of Frisco Street, 900+ feet south of Eldorado Parkway from Agricultural to Retail (2.2+ acres) and Commercial-1 (6.0+ acres) and consider and act to direct staff to prepare an Ordinance of the same.  Neighborhood #46.  (Planning & Development Services)

 

12. Consider and act upon the request for an interpretation of a proposed land use for Planned Development-32-Retail.  Neighborhood #34.  (Planning & Development Services)

 

13. Consider and act to give staff direction on the request of Quiet Zones and Wayside Horns to Eliminate Railroad Warning Horns at BNSF Rail Crossings South of Eldorado Parkway. (Engineering Services/BM)

 

14. Consider and act upon an Ordinance creating a Juvenile Case Manager Fund and establishing a Juvenile Case Manager Fee. (Administrative Services)

 

15. Consider and act upon whether to direct staff to submit a written notice of appeal on behalf of the City Council to Planning & Development Services, pursuant to Article IV, Section 1.07(C) of the Comprehensive Zoning Ordinance and/or Section 4.05 of the Subdivision Regulation Ordinance, regarding action taken by the Planning & Zoning Commission on any site plan or plat.  Any written notice of appeal must be submitted to Planning & Development Services.

 

16. City Council discussion with City Staff concerning any actions required by City Staff as a result of any item on tonight’s agenda.

 

17. Discussion on Governance Monitoring of present City Council Meeting.

 

18. Adjourn.
