You are invited to join the fun and festivities of "The E. Michael Simpson's Mayor Roast" benefiting The Miracle League of Frisco.  Join us on February 24, 2007 from 7PM to 10PM at the Embassy Suites/Frisco Convention Center at 7600 John Q. Hammons Drive.

Sponsorships are still available and all fund go to the Miracle League. If you have never attended a game; I encourage you to do so. It is a great organization and once you see the smile on the kids faces; you will be a believer.

And, as one of the official roasters, I'm always open to hearing some unique ways to roast our Mayor!

a.      Section 551.071.  Meeting with City Attorney regarding a matter(s) in which the duty of the City Attorney under the Texas Disciplinary rules of Professional Conduct of the State Bar of Texas conflicts with the Open Meetings Act regarding:

                                i.            Update on Cause 2006-50103-367; City of Frisco, Texas vs. Shoemaker;

                              ii.            Update regarding the Tolling of State Highway 121 and possible litigation regarding the same.

b.      Section 551.072.   To deliberate the purchase, exchange, lease or value of real property located:

                                i.            South of US 380, North of Lebanon Road, East of FM 423, and West of Preston Road.

c.      Section 551.087. Deliberation regarding commercial or financial information that the City has received from a business prospect and to deliberate the offer or other incentives to a business prospect.

B.)  Consider and act upon approval of a Release of Lien and Mutual Release Agreement by and between the City of Frisco and Texas Univest-Frisco, Ltd. and adoption of a Resolution authorizing the City Manager to execute the Agreement. (City Manager)

 

C.)   Consider and act upon adoption of a Resolution authorizing the City Manager to execute Amendment Number One to the Professional Services Agreement by and between the City of Frisco and HVJ Associates for construction materials testing laboratory services for the Frisco Heritage Center, Phase One Site Infrastructure. D.)  Consider and act upon approval of an Amendment to an Agreement between the City of Frisco and David Hickman for artist services for the Vivian Stark McCallum Neighborhood Park and Beavers Bend Trail Extension Public Art and adoption of a Resolution authorizing the City Manager to execute the Agreement. E.)  Consider and act upon adoption of a Resolution ratifying an Emergency Purchase Order and authorizing the City Manager to execute a Standard Form Agreement for Construction Services by and between the City of Frisco and Craig Olden, Inc. to perform emergency gabion retaining wall construction at Legacy Drive (Stewart Creek Crossing) (Engineering Services/EM)

 

F.)   Consider and act upon adoption of a Resolution authorizing the City Manager to execute an Agreement by and between the City of Frisco and Carl Walker, Inc. for the George A Purefoy Municipal Center Parking Garage. (Engineering/BM)

 

G.)  Consider and act upon approval of Change Order # 1 to Durable Specialties, Inc. for the Construction Services – Installation of Traffic Signals at the intersections of Legacy Drive at Lakehill Boulevard & Legacy Drive at Academy Drive. (Engineering Services/BM)

 

H.)  Consider and act upon adoption of a Resolution authorizing the City Manager to enter into a Consent to Easement Structures Agreement with the United States Army Corps of Engineers for the proposed sanitary sewer and water facilities associated with the Hills of Kingswood subdivision. I.)      Consider and act upon a Resolution authorizing the City Manager to execute an Easement for Water Facilities with the United States Army Corps of Engineers for the proposed water facilities associated with the Hills of Kingswood subdivision. (Engineering/EM)

 

J.)    Consider and act upon Ratification of Payment to CoServ Electric for the underground construction to install lighting for Custer Creek Farms Subdivision. (Engineering Services/EM)

 

K.)  Consider and act upon award of bid to Archer Western Contractors. Ltd., and act upon a Resolution authorizing the City Manger to enter into an Agreement for Construction Services for Reuse Pump Stations Expansion. (Engineering/EM)

 

10. Legislative Agenda:

(These items may legally require Council Action, but by Council Policy should be the City Manager’s responsibility.  The Legislative Agenda can be acted upon in one motion.  The concurrence of two council members is required to remove any item for separate discussion and action.  Council members may vote nay on any single item without comment and may submit written comments as part of the official record.) 

A.)  Consider and act upon adoption of an Ordinance for a Specific Use Permit for a Child Day Care Center on 3.6± acres on the west side of Legacy Drive, 500+ feet north of Main Street.  Zoned Agricultural.  SUP06-0014.  Neighborhood #45.  (Planning & Development Services)

 

Regular Agenda:

11. Presentation and discussion of Air Quality Study conducted in southeast Frisco and consider and act upon calling a Public Hearing regarding adoption of an Ordinance regarding Air Quality. (City Manager)

 

12. Public Hearing:  Specific Use Permit Case SUP06-0018. A request for a Specific Use Permit for an expansion of a Child Day Care Center on 2.5± acres on the south side of Stonebrook Parkway, 100+ feet east of Oakbrook Drive and consider and act to direct staff to prepare an Ordinance of the same.  Zoned Commercial-1 with a Specific Use Permit for a Child Day Care Center (S-135).  Neighborhood #23. (Planning & Development Services)

 

13. Presentation and Acceptance of the Fiscal Year 2006 Comprehensive Annual Financial Report and Auditor’s Report (Administrative Services/AC)

 

14. Consider and act upon whether to direct staff to submit a written notice of appeal on behalf of the City Council to Planning & Development Services, pursuant to Article IV, Section 1.07(C) of the Comprehensive Zoning Ordinance and/or Section 4.05 of the Subdivision Regulation Ordinance, regarding action taken by the Planning & Zoning Commission on any site plan or plat.  Any written notice of appeal must be submitted to Planning & Development Services.

 

15. City Council discussion with City Staff concerning any actions required by City Staff as a result of any item on tonight’s agenda.

 

16. Discussion on Governance Monitoring of present City Council Meeting.

 

17. Adjourn.
