                                i.            Update on Cause 2006-50103-367; City of Frisco, Texas vs. Shoemaker;

                              ii.            Update on Preston Trail Stone, LLC issues ;

                            iii.            Update on Municipal Judge and Associate Judge;

9.  Consent Agenda:

A.)  Consider and act upon approval of the Minutes from the January 3, 2007  Regular City Council Meetings.  (City Secretary)

 

B.)  Consider and act upon approval of an Amendment to the Agreement by and between the City of Frisco and Dean Electric, Inc. (d/b/a Dean Construction) for Construction Services for BF Phillips Park to establish the Guaranteed Maximum Price and adoption of a Resolution authorizing the City Manager to execute the Agreement. (Parks and Recreation)

 

C.)  Consider and act upon a Resolution authorizing the City Manager to execute Amendment Number One to the Professional Services Agreement by and between the City of Frisco and Schrickel, Rollins and Associates, Inc. for the design of the 24” Dallas Parkway Water Line (Warren – Lebanon) and Transfer Valve Station. (Engineering)

 

D.)  Consider and act upon a Resolution authorizing the City Manager to enter into an agreement with TXU Electric Delivery Company for an encroachment  of various public infrastructures within the proposed alignment of Throne Hall Drive, with an existing TXU Electric Delivery Company Easement. (Engineering)

 

E.)  Consider and act upon adoption of a Resolution authorizing the City Manager to execute Amendment Number One to a Professional Services Agreement by and between the City of Frisco and Kimley-Horn and Associates, Inc. for additional engineering services associated with Legacy Drive, Citation Court to Main Street. (Engineering)

 

F.)   Consider and act upon an approval of Change Order #3 to Environmental Infrastructure Group (EIG) for construction of the Eldorado/BNSF Railroad Pump Station. (Engineering)

 

G.)  Consider and act upon award of bid #0711-011 to Planet Ford 6 for pickups and Sam Pak’s Five Star Ford for the cab and chassis. (Administrative Services)

 

H.)  Consider and act upon award of bid #0711-012 to Southwest International Trucks, Inc. for dump trucks. (Administrative Services)

 

I.)      Consider and act upon the approval of a Grant Agreements by and between the City of Frisco and:

i.)      Collin County Children’s Advocacy Center, and adoption of a Resolution authorizing the City Manager to execute the Agreements. (HJH/CMO)

ii.)    CITY House, and adoption of a Resolution authorizing the City Manager to execute the Agreements. (HJH/CMO)

iii.)  CASA, and adoption of a Resolution authorizing the City Manager to execute the Agreements. (HJH/CMO)

 

10. Legislative Agenda:

(These items may legally require Council Action, but by Council Policy should be the City Manager’s responsibility.  The Legislative Agenda can be acted upon in one motion.  The concurrence of two council members is required to remove any item for separate discussion and action.  Council members may vote nay on any single item without comment and may submit written comments as part of the official record.) 

A.)  Consider and act upon adoption of an Ordinance granting a Specific Use Permit for a commercial antenna on a City water tank on 1.2+ acres, located on the north side of Eldorado Parkway, 1,300+ feet west of Coit Road.  Zoned Planned Development-2-Residential Village-Business Park-Neighborhood Commercial.  Specific Use Permit SUP06-0012.  Neighborhood #8.  (Planning & Development Services)

 

Regular Agenda:

11. Public Hearing:  Zoning Case Z06-0022, A request to rezone 15.8+ acres on the north side of S.H. 121, 1,000+ feet west of Custer Road from Agricultural to Highway and consider and act to direct staff to prepare an Ordinance of the same.  Neighborhood #27.  (Planning & Development Services)

 

12. Consider and act to give staff direction on the request of Stonelake Estates’ residents to close Ryan Street.  Neighborhood #15.  (Planning & Development Services) 

 

13. Consider and act upon approval of and Amendment to the Frisco Square Agreement and adoption of a Resolution authorizing the City Manager to execute the Agreement.  Tabled 01/03/07 (Administrative Services)

 

14. Consider and act upon proposed Settlement Agreement with Charles and Betty Shoemaker in Cause No. 2006-50103-367; City of Frisco, Texas vs. Charles E. Shoemaker and Betty D. Shoemaker and to authorize the City Manager to take all actions necessary to effectuate the same and adoption of a Resolution authorizing the City Manager to execute the Agreement. (City Manager’s Office/GP)

 

15. Consider and act upon whether to direct staff to submit a written notice of appeal on behalf of the City Council to Planning & Development Services, pursuant to Article IV, Section 1.07(C) of the Comprehensive Zoning Ordinance and/or Section 4.05 of the Subdivision Regulation Ordinance, regarding action taken by the Planning & Zoning Commission on any site plan or plat.  Any written notice of appeal must be submitted to Planning & Development Services.

 

16. City Council discussion with City Staff concerning any actions required by City Staff as a result of any item on tonight’s agenda.

 

17. Discussion on Governance Monitoring of present City Council Meeting.
